Introduction
These Terms of Use (the "Terms") set out the rules and conditions that govern your access to and use of the MyMacroGo service, including the MyMacroGo mobile app (available on iOS and Android devices), any associated website, web-based features, and all related content, functionalities, and services (collectively, the "Services"). The Services are operated by MyMacroGo Ltd, a company registered in England and Wales under company number 16775441, with its registered office at 128 City Road, London, United Kingdom, EC1V 2NX ("MyMacroGo", "we", "us", or "our").
By downloading, installing, accessing, registering for, or otherwise using the Services in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms, our Privacy Policy (available at [insert link to Privacy Policy]), and any additional terms, guidelines, or rules we may post within the Services from time to time (e.g., Community Guidelines for forums or specific feature terms). If you do not agree with any part of these Terms, you must immediately cease all use of the Services and delete the app if installed.
These Terms form a legally binding agreement between you (either an individual or, if applicable, the entity you represent) and MyMacroGo. You must be at least 18 years of age and legally competent to enter into contracts to use the Services. The Services are designed exclusively for adult users and are not intended for minors (see Section 12 for details on restrictions for children). If you are accessing or using the Services on behalf of a company, organisation, or other legal entity, you represent and warrant that you have the full authority to bind that entity to these Terms, and "you" shall refer to that entity.
We reserve the right to modify, update, or revise these Terms at any time in our sole discretion. We will notify you of any material changes by posting the updated Terms prominently within the app, on the website, or via email or in-app notification (where we have your contact details and law requires it). Such changes will take effect immediately upon posting or as specified in the notice. Your continued use of the Services after any changes constitutes your unconditional acceptance of the revised Terms. It is your sole responsibility to review these Terms regularly to stay informed of any updates. If you do not agree to the changes, you must stop using the Services.
These Terms incorporate by reference all other policies referenced herein, and in the event of any conflict between these Terms and any such policies, these Terms shall prevail unless expressly stated otherwise.
Prominence of Key Disclaimers: To ensure you fully understand the critical limitations and risks associated with the Services, during onboarding and registration, you will be required to separately review and affirmatively acknowledge (via checkbox or similar interactive prompt) specific disclaimers regarding health risks (e.g., potential for inaccurate nutritional guidance leading to dietary imbalances or health issues) and data reliability (e.g., limitations in AI accuracy for meal scanning or macro tracking). These acknowledgements are mandatory for account creation and continued use.
Description of the Services
The MyMacroGo Services are a mobile-first platform designed to assist adult users in tracking and managing their macronutrient intake (including proteins, carbohydrates, and fats), monitoring calorie consumption, logging meals and physical activities, scanning menus for nutritional estimates, and receiving personalised nutrition insights through AI-powered tools. The Services aim to support general wellness and dietary awareness but are not a medical or professional service.
Key features of the Services include, but are not limited to:
· Macro Tracking and Logging: Tools for manual entry of food items or AI-assisted logging via text, barcode scanning, or photo uploads to estimate and track daily macronutrient breakdown, total calories, and other nutritional metrics.
· Menu and Food Scanning: Utilisation of your device's camera to analyse images of restaurant menus, packaged foods, or meals for approximate nutritional data, including macronutrients and allergens (where detectable).
· Personalised Recommendations and Insights: AI-generated suggestions for meal plans, goal adjustments, progress reports, and motivational content based on user-provided profile data (e.g., age, height, weight, activity levels).
· Integrations with Third-Party Tools: Optional connections to external fitness and health platforms such as Apple Health (for iOS devices), Google Fit (for Android devices), Fitbit, Garmin, or similar services to import/export data like step counts, workouts, calories burned, or sleep patterns.
· Location-Based Functionality: With your explicit consent and permission, access to real-time device location data (via GPS or similar technologies) to recommend nearby restaurants, cafes, or food options with available nutritional information tailored to your dietary goals.
· Push Notifications and Alerts: Customisable notifications delivered to your device, including reminders for meal logging, progress updates, motivational tips, or service-related announcements.
· Community and Social Features: Optional access to user forums, discussion boards, or sharing options for peer support, recipe exchanges, or progress sharing (subject to strict Community Guidelines to ensure respectful and appropriate interactions).
· Subscriptions and Premium Access: A free tier with basic tracking features; premium subscriptions unlock advanced AI analytics, unlimited scans, an ad-free experience, detailed reports, and priority support.
Access to the Services is provided on a non-exclusive, non-transferable basis for personal, non-commercial use only. We may, at our absolute discretion, add, remove, modify, suspend, or discontinue any feature, functionality, or aspect of the Services at any time, with or without notice, and without any liability to you. This includes temporary or permanent shutdowns for maintenance, updates, or other operational reasons. You acknowledge that the Services may not be available at all times, may experience interruptions, or may vary by device, operating system, or location.
Critical Accuracy and Health Disclaimer: The Services, including all AI-driven features such as macro tracking, menu scanning, nutritional calculations, and personalised recommendations, are provided solely for general informational, educational, and entertainment purposes. They are not designed, intended, or certified as medical devices, diagnostic tools, or professional nutritional advice. All data and outputs (e.g., estimated protein, carbohydrate, or fat content; calorie counts; BMI or BMR calculations) are based on user inputs, third-party databases (such as FatSecret or OpenFoodFacts), algorithmic estimates, and assumptions that may not account for real-world variables like exact portion sizes, cooking methods, ingredient substitutions, individual metabolic differences, or environmental factors. As a result, the Services may produce inaccurate, incomplete, or unreliable results.
AI-Specific Limitations: The AI functionalities in the Services rely on machine learning algorithms trained on diverse but finite datasets, which may contain inherent biases (e.g., underrepresentation of certain cultural diets, regional ingredients, or demographic groups). These algorithms are probabilistic and may generate false positives (e.g., overestimating allergen risks in scans) or false negatives (e.g., missing subtle nutritional variances), leading to potentially misleading outputs. We do not guarantee the absence of such errors, and you acknowledge the experimental and evolving nature of AI technologies. Outputs should always be verified independently.
We take no responsibility whatsoever, and expressly disclaim all liability, for any misuse, misunderstanding, misinterpretation, or incorrect application of the information provided by the Services, including but not limited to errors in macronutrient tracking (e.g., over- or under-estimating protein intake leading to dietary imbalances), reliance on scanned menu data for allergen avoidance, or using recommendations in ways that could affect your health, fitness, or well-being. For example, if you miscalculate your protein needs based on app estimates and this leads to inadequate nutrition, excessive intake, or other issues, you alone bear full responsibility. The Services are not a substitute for advice from qualified healthcare professionals, registered dietitians, doctors, or nutritionists. You should always consult with such professionals before making any changes to your diet, exercise routine, or health regimen, especially if you have pre-existing medical conditions, allergies, or are pregnant/breastfeeding.
By using the Services, you acknowledge and agree that you will not hold MyMacroGo, its officers, directors, employees, agents, affiliates, or licensors responsible for any adverse outcomes, injuries, illnesses, or damages arising from your use (or misuse) of the Services. This includes, without limitation, any decisions you make based on the app's outputs, such as meal choices, supplement use, or fitness goals. We strongly recommend verifying all nutritional information independently and using the Services only as a supplementary tool.
User Accounts and Responsibilities
To fully access and utilise the Services, you are required to create and maintain a personal user account ("Account"). During registration, you must provide accurate, current, and complete information as prompted (e.g., email address, first name, optional last name, and profile details such as age, sex, height, weight, and dietary preferences). You agree to keep this information up-to-date at all times and to promptly notify us of any changes.
Your responsibilities regarding your Account include:
· Maintaining the confidentiality and security of your login credentials (e.g., email and password). You are solely responsible for all activities that occur under your Account, whether authorised by you or not.
· Notifying us immediately at support@mymacrogo.com of any unauthorised access, use, or breach of your Account.
· Ensuring that your use of the Services complies with all applicable laws, regulations, and these Terms, including those related to data privacy, health claims, and consumer protection.
· Regularly reviewing and managing linked third-party accounts (e.g., Apple Health) to ensure permissions are current and data syncing is secure.
You agree not to:
· Create or attempt to create multiple Accounts, use automated systems (e.g., bots or scripts) to register, or engage in any fraudulent activity.
· Impersonate any person or entity, provide false personal information, or misrepresent your affiliation with any third party.
· Share, sell, transfer, or sublicense your Account to others.
· Use the Services in any manner that could damage, disable, overburden, or impair the Services or interfere with any other user's experience.
User Warranties Regarding Medical Suitability: You expressly warrant and represent that you are not using the Services for the diagnosis, treatment, prevention, or cure of any health condition, disease, or medical issue. You confirm that you have consulted with a qualified healthcare professional if you have any pre-existing conditions, vulnerabilities (e.g., eating disorders, allergies), or special circumstances (e.g., pregnancy), and that the Services are being used solely as a general wellness tool, not as a substitute for professional medical advice.
We reserve the right to monitor Account activity for compliance and may, in our sole discretion, suspend, restrict, or terminate your Account (and access to the Services) at any time, with or without notice, for any reason, including suspected violations of these Terms, inactivity, or to protect the integrity of the Services. Upon termination, you will lose access to all Account data, and we will have no obligation to provide backups or refunds unless required by law. Sections of these Terms that by their nature should survive termination (e.g., disclaimers, liability limitations, indemnity) will continue to apply.
Subscriptions, Payments, and Billing
The Services are available on a freemium model: basic features are free, while premium features (e.g., unlimited AI scans, advanced analytics, custom meal plans) require a paid subscription ("Premium Services"). Subscriptions are offered on a monthly, annual, or other periodic basis, as specified during purchase.
· Billing and Payment: All payments for Premium Services are processed securely through third-party providers: Apple In-App Purchases for iOS devices, Google Play Billing for Android devices, or Stripe for any website-based purchases (if available). By subscribing, you authorise us (via these providers) to charge your selected payment method regularly at the then-current rates until you cancel. You are responsible for ensuring your payment method has sufficient funds and for any transaction fees or currency conversions.
· Auto-Renewal and Cancellation: Subscriptions automatically renew at the end of each term unless cancelled at least 24 hours before renewal. You may cancel via your device store account (Apple App Store or Google Play Store) or, for website purchases, through your Stripe account. Cancellations take effect at the end of the current billing period; no partial refunds are provided.
· Free Trials and Promotions: If a free trial is offered, it will automatically convert to a paid subscription unless cancelled before the trial ends. Promotional pricing or discounts are non-transferable and may be subject to additional terms.
· Refunds and Price Changes: Refunds are not provided except where required by applicable law (e.g., under the UK Consumer Rights Act 2015 for faulty services or the 14-day cooling-off period for digital content). We may adjust pricing, features, or subscription tiers with reasonable notice via email or in-app alert; continued use after changes constitutes acceptance. You are responsible for all taxes, duties, or levies applicable to your use of the Services.
· Failed Payments: If a payment fails, we may suspend Premium Services until resolved, and repeated failures may lead to Account termination.
For full details on payment processing, refer to Apple's App Store Terms of Service, Google's Google Play Terms of Service, or Stripe's Services Agreement. We are not responsible for any disputes, errors, or fees arising from these providers.
User Content, Licensing, and Conduct
You may generate, upload, input, or submit content to the Services, such as meal photos, food descriptions, forum posts, profile updates, or custom notes ("User Content"). All User Content is submitted voluntarily and at your own risk.
By submitting User Content, you automatically grant MyMacroGo a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully paid-up, transferable, and sublicensable licence to use, copy, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, display, and perform such User Content in connection with the operation, promotion, improvement, and research related to the Services. This includes using anonymised or aggregated User Content to train AI models, generate insights, or develop new features, without further notice or compensation to you. You also waive any moral rights or similar rights in your User Content to the extent permitted by law.
You represent, warrant, and covenant that:
· You own or control all rights in your User Content necessary to grant the above licence.
· Your User Content does not and will not infringe, misappropriate, or violate any third-party rights (e.g., copyrights, trademarks, privacy, publicity, or data protection laws).
· Your User Content is accurate, truthful, and not deceptive or misleading.
· Your User Content complies with all applicable laws and these Terms.
We are under no obligation to review, monitor, or moderate User Content but may do so at our discretion. We reserve the right to remove, edit, or refuse any User Content for any reason, including violations of law or these Terms, without notice or liability. You retain ownership of your User Content but acknowledge that once submitted, it may be difficult to retract.
Prohibited Conduct: To ensure a safe and positive experience for all users, you agree not to engage in any of the following (or attempt to do so):
· Uploading or transmitting any harmful code, viruses, malware, or other disruptive elements.
· Using the Services for any illegal, fraudulent, or unauthorised purpose, including promoting scams, hate speech, discrimination, or violence.
· Harassing, threatening, defaming, or invading the privacy of other users or third parties.
· Posting spam, unsolicited advertising, chain letters, or pyramid schemes.
· Collecting or soliciting personal information from minors or without consent.
· Reverse-engineering, decompiling, disassembling, or otherwise attempting to derive the source code of the Services.
· Using automated tools, scripts, or bots to access or interact with the Services, except as expressly permitted.
· Interfering with the Services' functionality, security, or performance, or bypassing any access controls.
· Making unauthorised commercial use of the Services, such as reselling data or features.
· Sharing inaccurate health or nutritional information that could mislead others.
Violations of this Section may result in immediate Account suspension or termination, content removal, and reporting to authorities if required by law. We cooperate fully with law enforcement in investigating suspected illegal activity.
Intellectual Property Rights
All rights, title, and interest in and to the Services, including but not limited to software, code, algorithms, databases, designs, graphics, text, logos, trademarks, service marks, and other intellectual property (collectively, "MyMacroGo IP"), are and shall remain the exclusive property of MyMacroGo or our licensors. The Services are protected by UK copyright laws, the Copyright, Designs and Patents Act 1988, and international treaties. Nothing in these Terms grants you any ownership or proprietary rights in the MyMacroGo IP.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-transferable, non-sublicensable licence to access and use the Services solely for your personal, non-commercial purposes. This licence does not include rights to:
· Copy, distribute, publicly display, or perform any MyMacroGo IP except as necessary for your permitted use.
· Modify, adapt, translate, or create derivative works from the Services.
· Use the MyMacroGo IP in any way that suggests endorsement or affiliation without prior written consent.
· Remove or alter any proprietary notices, labels, or marks.
Our trademarks (e.g., "MyMacroGo", app logos) are protected and may not be used without express permission. If you believe your intellectual property rights have been infringed by the Services or User Content, please notify us in writing at support@mymacrogo.com with details of the alleged infringement, and we will investigate promptly in accordance with applicable laws (e.g., the Digital Economy Act 2010 for copyright notices).
You agree to respect third-party intellectual property and report any suspected infringements you encounter.
Third-Party Services, Links, and Integrations
The Services may contain links to, or integrations with, third-party websites, apps, services, or content (e.g., Apple Health, Google Fit, FatSecret API, Google Gemini for AI processing, Stripe for payments). These third-party elements are provided solely for your convenience and do not imply endorsement, sponsorship, or affiliation by MyMacroGo.
Your use of any third-party services is at your own risk and governed entirely by their respective terms of service, privacy policies, and other agreements. We have no control over, and expressly disclaim all responsibility for, the availability, accuracy, completeness, security, privacy practices, or content of such third parties. We are not liable for any loss, damage, or claims arising from your interactions with them, including data breaches, errors in synced information, or unauthorised access.
For integrations (e.g., syncing health data with Apple Health), you must grant explicit permissions, and data sharing complies with their developer policies (e.g., Google's Limited Use Policy). Revoking permissions may limit Service functionality. We recommend reviewing third-party privacy policies before connecting.
Disclaimers, Health Warnings, and Limitation of Liability
General Disclaimers: The Services are provided "AS IS" and "AS AVAILABLE" without any representations, warranties, or conditions of any kind, whether express, implied, statutory, or otherwise. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, or that the Services will be error-free, uninterrupted, secure, or compatible with your device. We do not warrant that the Services will meet your requirements, that any defects will be corrected, or that the Services are free of viruses or other harmful components. Your use of the Services is at your sole risk.
Specific Health and Nutritional Disclaimers: As emphasised in Section 2, the Services are not intended to provide medical diagnosis, treatment, prevention, or cure for any health condition. We make no claims or guarantees regarding the efficacy, safety, or suitability of any nutritional tracking, recommendations, or insights for achieving health outcomes. You acknowledge that:
· Misuse or misunderstanding of macronutrients (e.g., incorrect protein targets leading to muscle strain, kidney issues, or nutritional deficiencies) is entirely your responsibility.
· The Services cannot account for individual factors like genetics, medications, allergies, or lifestyle, and errors in data entry or scanning could result in flawed outputs.
· Any reliance on the Services for dietary decisions could lead to unintended consequences, and we disclaim all liability for such outcomes.
We take no responsibility for any physical, mental, emotional, or financial harm, injury, death, or loss resulting from your use, misuse, or inability to use the Services. This includes claims related to weight changes, dietary imbalances, exercise overexertion, or allergic reactions based on app-suggested foods.
Limitation of Liability: To the maximum extent permitted by applicable law (including the Unfair Contract Terms Act 1977 and Consumer Rights Act 2015), MyMacroGo, its directors, officers, employees, agents, affiliates, licensors, and suppliers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, use, or anticipated savings, whether arising in contract, tort (including negligence), strict liability, or otherwise, even if advised of the possibility of such damages. In no event shall our total aggregate liability to you exceed the greater of £100 (one hundred pounds sterling) or the total amount you paid to us (if any) for the Services in the twelve (12) months preceding the event giving rise to the claim.
This limitation applies to all claims, disputes, or causes of action, and survives termination. Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above may not apply to you in full— in such cases, our liability shall be limited to the minimum extent permitted by law.
Indemnification: You agree to defend, indemnify, and hold harmless MyMacroGo and the aforementioned parties from and against any claims, suits, losses, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (i) your use or misuse of the Services; (ii) your User Content; (iii) your violation of these Terms or any law; (iv) your infringement of third-party rights; or (v) any interaction with other users. We reserve the right to assume the exclusive defence and control of any matter subject to indemnification, in which case you agree to cooperate fully.
These provisions are intended to allocate risks between the parties and limit potential liability to the extent permitted by law. By using the Services, you confirm your understanding and acceptance of these protections.
Termination and Suspension
You may terminate your Account and these Terms at any time by deleting the app and contacting support@mymacrogo.com to request Account closure. Upon termination, you will lose access to all Services, and any unused prepaid fees are non-refundable except as required by law.
We may terminate or suspend your access to the Services, in whole or in part, immediately and without notice or liability if we believe, in our sole discretion, that: (i) you have breached these Terms; (ii) such action is necessary to protect the rights, property, or safety of MyMacroGo, users, or the public; (iii) your use imposes undue burden on our infrastructure; or (iv) required by law. Upon any termination, all licences granted to you cease, and you must immediately stop using the Services.
Provisions that survive termination include, but are not limited to, Sections 2 (Accuracy Disclaimer), 5 (User Content Licensing), 6 (Intellectual Property), 8 (Disclaimers and Liability), 9 (Termination), 10 (Governing Law), and 11 (Miscellaneous).
Governing Law, Dispute Resolution, and Arbitration
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes) shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. Notwithstanding the foregoing, we retain the right to seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of our intellectual property rights.
Carve-Out for Platform-Specific Disputes: To the extent that disputes arise directly from transactions processed through Apple In-App Purchases or Google Play Billing, such disputes may be subject to the mandatory arbitration and class action waiver provisions in Apple's App Store Terms of Service or Google's Google Play Terms of Service, as applicable. You agree that these platform terms supersede conflicting provisions in these Terms solely for such platform-specific disputes, but all other disputes remain governed by this Section.
We are committed to resolving issues amicably. If you have a complaint, please contact support@mymacrogo.com with details, and we will respond within 7 working days. If unresolved, you may escalate to alternative dispute resolution services, such as those provided by the UK Centre for Effective Dispute Resolution (CEDR) or the Information Commissioner's Office (for data issues). In certain cases, binding arbitration may apply under platform terms (e.g., Apple or Google disputes).
To the extent permitted by law, you waive any right to participate in class actions, collective claims, or representative proceedings against us.
Miscellaneous Provisions
· Entire Agreement: These Terms, together with the Privacy Policy and any referenced documents, constitute the entire agreement between you and MyMacroGo regarding the Services and supersede all prior or contemporaneous understandings, whether oral or written.
· Severability: If any provision of these Terms is held invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
· No Waiver: Our failure to exercise or enforce any right or provision shall not constitute a waiver of such right or provision.
· Assignment: We may freely assign or transfer these Terms and our rights/obligations hereunder to any successor or affiliate without your consent. You may not assign or transfer these Terms without our prior written approval.
· Force Majeure: We shall not be liable for any delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, pandemics, labour disputes, governmental actions, internet failures, or third-party service outages (including, without limitation, failures or disruptions in integrations with Google Fit, Apple Health, Stripe, or other external APIs or platforms).
· Export Controls and Sanctions: You agree to comply with all applicable export control laws, sanctions, and regulations (e.g., UK Export Control Order 2008, US EAR/ITAR). The Services may not be used by persons or entities subject to restrictions, and you represent that you are not located in a prohibited jurisdiction.
· Relationship of the Parties: These Terms do not create any partnership, joint venture, agency, or employment relationship between you and MyMacroGo.
· Third-Party Beneficiaries: Except for our licensors and affiliates (who are express third-party beneficiaries), there are no third-party beneficiaries to these Terms.
· Notices: All notices to you will be via email or in-app; notices to us must be in writing to the address above.
· Headings: Section headings are for convenience only and do not affect interpretation.
Data Protection Note: Health and biometric data collected via AI features or third-party integrations (e.g., meal scans, activity syncing) is processed under a separate lawful basis as outlined in our Privacy Policy, distinct from general usage data, in compliance with UK GDPR. Use by Children and Vulnerable Users
The Services are not directed to, and we do not knowingly collect personal information from, children under the age of 18. Nutritional and fitness tracking features are calibrated for adult physiology and may be inappropriate or unsafe for minors. If we become aware of any such use, we will terminate the Account and delete related data promptly.
Users with vulnerabilities (e.g., eating disorders, severe allergies) should consult professionals before using the Services, as general recommendations may not suit individual needs. We disclaim liability for any harm to vulnerable users.
Parents or guardians who believe a child has accessed the Services should contact us immediately at support@mymacrogo.com for assistance with data removal.
